TINJAUAN YURIDIS PELANGGARAN HUKUM YANG DILAKUKAN OLEH WARGA NEGARA ASING YANG BERADA DI WILAYAH NKRI

Abstract

Refugees who leave their homeland are caused by various factors, usually because of things that can endanger the lives of refugees while still settling in their hometown, such as war or persecution. They don't get protection from their own country, even often their own government threatens to persecute them. This study uses normative juridic methods. Other forms of violations of the law committed by foreign nationals as refugees in the territory of the NKRI include entering Indonesia illegally, fighting, rape, and destroying refugee facilities. Then the cause of the occurrence of the violations made by foreign citizens as refugee in the Territory is the existence of differences in national rules, culture, and customs in Indonesia and in the country of origin. Another reason why refugees and asylum-seekers roam to commit violations is the lack of immigration detention facilities in Indonesia. The Indonesian government has established special rules on the conduct of refugees and asylum-seekers in its territory, so as not to disregard the behaviour of the refugee and asylees. So other countries can take the Indonesian example in dealing with the refugee problem even though Indonesia is not a party to the 1951 Convention. It can help reduce to prevent the occurrence of violations committed by refugees.
