Merujuk pada pertimbangan hukum Hakim Mahkamah Agung pada Tingkat Kasasi pasca Putusan Mahkamah Konstitusi Nomor 37/PUU-IX/2011 dalam Perkara Nomor 157 K/Pdt.Sus-PHI/2018 tanggal 14 Maret 2018 yang memutus upah proses paling banyak 6 (enam) bulan sesuai Yurisprudensi Mahkamah Agung RI adalah berkiblat kepada Kepmenaker Nomor 150 Tahun 2000 tentang Penyelesaian Pemutusan Hubungan Kerja dan Penetapan Uang Pesangon, Uang Penghargaan Masa Kerja dan Ganti Kerugian di Perusahaan. Akibat hukum pelaksanaan upah proses pasca putusan Mahkamah Kontistusi Nomor 37/PUU-IX/2011 dirasakan tidak adil bagi pengusaha. Putusan Mahkamah Konstitusi Nomor 37/PUU-IX/2011 tanggal 19 September 2011 itu memastikan tambahan beban keuangan bagi perusahaan terutama bila melakukan Pemutusan Hubungan Kerja (PHK) yang menyimpang dengan hukum. Bila dalam praktik peradilan terdapat sikap yang berbeda dari para hakim dalam memutus upah proses, kini perbedaan itu telah berakhir apabila semua pihak menghormati putusan Mahkamah Konstitusi Nomor 37/PUU-IX/2011 tanggal 19 September 2011, putusan itu akan menjadi landasan hakim untuk seragam menghukum pengusaha membayar upah proses Pemutusan Hubungan Kerja (PHK) sampai putusan berkekuatan hukum tetap.

Abstract


Referring to the legal considerations of the Supreme Court Judge at the Cassation Level after the Constitutional Court Decision Number 37 / PUU-IX / 2011 in Case Number 157 K / Pdt.Sus-PHI / 2018 dated March 14, 2018 which decided the process fee at most 6 (six) months in accordance with the Supreme Court Jurisprudence of the Republic of Indonesia is oriented to Kepmenaker Number 150 of 2000 concerning the Termination of Employment Termination and Determination of Severance Pay, Tenure Award and Compensation in the Company. The legal consequences of the implementation of process wages after the decision of the Constitutional Court Number 37 / PUU-IX / 2011 are felt to be unfair to employers. Decision of the Constitutional Court Number 37 / PUU-IX / 2011 dated September 19, 2011 ensures an additional financial burden for companies, especially when terminating work relationships (PHK) that deviates from the law. If in judicial practice there is a different attitude from the judges in deciding the process fee, now the difference has ended if all parties respect the decision of the Constitutional Court Number 37 / PUU-IX / 2011 dated September 19, 2011, that decision will become the basis for judges to uniformly punish The employer pays the wages the Termination of Employment (PHK) process until the decision has final legal force.
